MAKRO Customer Terms and Conditions

These Terms and Conditions must be respected by all customers


1. The terms used in Terms and Conditions mean the following:
    • MAKRO – MAKRO Cash and Carry Polska S.A. with its headquaters in  Warsaw,  Al.Krakowska 61, 02-183 Warsaw.
    • Metro – commercial locations of the network Metro/MAKRO Cash and Carry outside the Republic of Poland, dependent of Metro AG with headquaters in Duesseldorf (Germany).
    • MAKRO Customer – a physical or a legal person, an organizational unit not being a legal person, who has the legal capacity in the light of the law, purchasing products in the network MAKRO Cash and Carry Polska S.A. for the purposes related to the business run, not being a consumer.
    • The holder of a MAKRO Customer Card – a physical person authorised by a MAKRO Customer to purchase products in MAKRO.
    • (MGI) “Data centres” – Metro-Group Information Technology GmbH – a society  providing IT services within the Metro group.
2. The MAKRO Customer Card is for personal use only and should not be passed to third parties. The MAKRO Customer Card holder may be asked to present proof of identification on entering the store.
3. The card may only be used by the MAKRO Customer Card holder, whose name and surname appear on the MAKRO Customer Card. The MAKRO Customer Card holder may be accompanied by one person while purchasing.
4. A MAKRO customer should immediately notify in writing the MAKRO Department of Customer Care in the event of:
withdrawal of the authorization for MAKRO Customer Card holder, loss of a MAKRO Customer Card, change of address, the termination or suspension of business or any other important changes related to the running of the business.
5. A MAKRO customer loses both his MAKRO Customer Card and the right to purchase in MAKRO in the event of:
    • An offence or a crime committed by a MAKRO Customer Card holder or an accompanying person on the MAKRO premises.
    • Suspension, liquidation or termination of business.
    • A MAKRO customer not making any purchases for a period of more than one year.
6. MAKRO reserves the right to invalidate a MAKRO Customer Card if the clauses of the present terms and conditions are not adhered to by the MAKRO Customer or MAKRO Customer Card holder. In the event of invalidation of the MAKRO Customer Card the MAKRO Customer can not purchase in MAKRO or Metro and is obliged to return all the MAKRO Customer Cards previously obtained.
7. For safety reasons children of a height below 140 cm (including babies and children in carriers, prams, etc) are not permitted on the MAKRO premises. MAKRO does not take responsibility for children left without parental control on the MAKRO premises. Persons on the MAKRO premises should stay particularly vigilant because of fork-lift trucks in operation.
8. It is not permitted to bring the following items to the MAKRO premises: bags, cases, backpacks, shopping and devices registrating image and sound. MAKRO enables the MAKRO Customer Card Holders to deposit their properties in special lockers, where it is possible to leave objects not bigger than 50x30x60cm ( height, width, depth). MAKRO does not take responsibility for properties left in the deposit lockers.
9. Animals are not admitted inside MAKRO.
10. In case of opening, distroying of damaging goods inside MAKRO by the MAKRO Customer Card Holder or the accompanying person, the MAKRO Customer Card Holder will be obliged to indemnify MAKRO with the sum equaling the price of the above mentioned goods.
11. Parking on the MAKRO premises is not guarded. MAKRO does not take any responsibility for vehicles and objects left in vehicles in the car park.
12. MAKRO gathers, processes and uses information (“Personal data”) included in the registration form or in other forms for administration purposes, for the realization of the contract between the customer and MAKRO, for a comprehensive and a long-term care about the customer and the individual service of the customer, as well as for promoting sales and for market and public opinion monitoring (by means of traditional mail, the Internet and other accessible communication channels).
13. MAKRO is a part of Metro Group, a large group of companies operating on international scale. Your personal data may be transfered from MAKRO to one of international data centres of the Metro Group ( led by (MGI) “Data Centres’) and processed in Data Centres within the realization of the purposes defined in point 13. MAKRO and Data Centres operate according to European regulations within the personal data protection in order to assure the right level of protection of the data, even when the data is sent to countries where another level of protection abides.
14. Your Personal Data will only be accessible to authorized employees in the scope described in point 13 as well as in securing and maintaining the IT technologies. MAKRO undertakes suitable technological and organizational actions in order to provide security and confidentiality of your Personal Data and thus systematically analizes and improves these actions adjusting them, when necessary, to legal changes or new technologies.
15. It is not compulsory to reveal your Personal Data for the purpose of processing it by MAKRO. It is possible to have access to one’s own data, ask for updating, corrections, blocking access or deleting Personal Data from the database.
16. The consent given herewith may be withdrawn by you at all times. The withdrawal of the consent entails the loss of a MAKRO Customer Card and of the right to buy within the MAKRO premises
